The Clarification Text on the Protection of Personal Data

THE CLARIFICATION TEXT ON THE PROTECTION OF PERSONAL DATA

We, as Marmara Uluslararası İnşaat ve Ticaret Anonim Şirketi (“Company” or “Data Controller”), respect the personal data we manage while carrying out our activities and care about the protection of fundamental rights and freedoms, primarily the privacy of private life, while processing personal data. We, as the data controller under Law No. 6698 on the Protection of Personal Data (“LPPD”), would like to inform you about the ways your personal data are collected, the purposes of the processing, legal grounds, and our mutual rights and obligations, and to seek your consent with this clarification text.

Collection, Processing Personal Data and Purposes of Processing

Although your personal data may vary depending on the services and activities provided by our company, our authorized employees may collect your personal data verbally, in writing, or electronically by automatic or non-automatic methods, through bilateral conversations or a website, telephone, e-mail, or similar electronic means of communication. Furthermore, as long as the legal relationship between you and the company is maintained, your personal data may be updated and processed, and they will be stored in printed and/or electronic media for the period prescribed by the applicable legislation or required for the purpose for which they are processed. All technical and managerial precautions shall be taken to protect and secure your personal data and to maintain compliance with the requirements for retention.

Your personal data is processed for the following purposes:

Fulfilling the legal requirements related to the Company’s activities,

Providing the legal and commercial security of real or legal persons who maintain any commercial relationship or business or service relationship with the Company, and executing the relevant agreements in accordance with the applicable legislation and Company policy,

Performing company activities in accordance with the legislation, company policies, and procedures, preparing personnel files,

Managing occupational health and safety processes Managing recruitment processes,

Establishing contracts,

Providing accommodation services, taking reservations, making sure that customers benefit from accommodation and other hotel facilities,

Conducting market research and purchasing operations in order to render better and more reliable service to our customers with no interruption and achieve customer satisfaction,

Managing legal processes,

Providing security and working peace and tranquillity in our workplaces, Running the organization and activities,

Executing and following up on the procedures,

Informing authorized institutions in accordance with the applicable legislation.

Transfer of Personal Data

Your personal data may be transferred to business partners, shareholders, holdings to which our Company is affiliated, subsidiaries, companies from which our Company procures services as a supplement or extension of its activities, suppliers, subcontractors, banks, ministries, municipalities, support service providers, contracted companies, institutions that cooperate in accordance with the provisions of the legislation, public authorities and bodies, and law enforcement agencies for the purposes set out above and under the applicable legal provisions and the requirements and purposes of processing personal data set out in Articles 8 and 9 of the LPPD.

 

Personal data shall never be transferred abroad without the explicit consent of the data subject. However, the transfer of personal data abroad, regardless of the explicit consent of the data subject, requires one of the conditions set out in Article 6 above, as well as the following conditions pursuant to Article 9 of the LPPD:

If sufficient protection is available in the foreign country,

Where no sufficient protection is available, if the data controllers in Türkiye and in the respective foreign country undertake to provide sufficient protection in writing and if the data controller holds the clearance of the Authority.

The countries where sufficient protection is available for transfer abroad shall be designated and announced by the Authority. The personal data may be transferred abroad, without prejudice to the provisions of international conventions, in cases where the interests of Türkiye or the data subject would be seriously harmed, but only with the approval of the Authority after consulting the relevant public institution or organization. The provisions set forth in other laws on the transfer of personal data abroad are reserved.

Method and Legal Causes for Collecting Personal Data 

Your personal data are collected in all kinds of verbal, written, or electronic media for the purposes set out under the first section of this text, to deliver our products and services within the designated legal framework and to allow our Company to fulfil its contractual and legal responsibilities accordingly fully and accurately. Your personal data collected for this purpose may be processed and transferred under the conditions of processing personal data defined in Articles 5 and 6 of the LPPD and in accordance with the conditions stipulated in the first two articles hereof.

 Accordingly, your personal data may be processed upon your explicit consent and if it is explicitly prescribed by the laws referred to in the LPPD, in cases of bodily incapability, the establishment or performance of a contract, the Company’s fulfilment of its legal obligation, making the data public by data subjects, or the establishment, exercise, or protection of a right, without your explicit consent, as long as it serves the company’s legitimate interests and doesn’t compromise your fundamental rights and freedoms. Your personal data of a special nature may be processed upon your explicit consent, whereas your personal data of a special nature other than medical data may be processed without seeking your explicit consent in cases prescribed by law. Your medical data can only be processed by any person who is bound by the obligation of confidentiality for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services, and financing.

  1. Rights of the Data Subject

As a data subject, you have the following rights under Article 11 of the LPPD:

  • to learn whether your personal data are processed or not,
  • to request information if your personal data are processed,
  • to learn the purpose of data processing and whether this data is used for intended purposes,
  • to know the third parties to whom your personal data is transferred at home or abroad,
  • to request the rectification of the incomplete or inaccurate data, if any,
  • to request the erasure or destruction of your personal data under the conditions set forth in the LPPD, and request notification of the operations carried out in respect thereof to third parties to whom your personal data has been transferred,
  • to object to the processing, by automatic means, of your personal data, which leads to an unfavourable consequence for the data subject,
  • to request compensation for the damage arising from the unlawful processing of your personal data.

You can send your request for exercising your rights to us by sending it to our mail, fax, or registered e-mail address indicated below with a secure electronic signature, or by filling out the Application Form on our website, or in accordance with the method if the Personal Data Protection Board defines a different method in writing and with a wet signature along with the certificates that prove your identity.
